1. Agreement and service
These Terms govern the business service CallbackCash supplied by mohamad abu kamir, registration 215528308, at Usfiya 6, Haifa, Israel, Israel (we/us). You contract with us for service access and with Paddle for orders. By accepting these Terms or continuing to use the service, you agree to them on behalf of your business. The service helps local businesses follow up missed calls, leads and WhatsApp conversations, use supervised AI replies, and measure potential and recovered revenue; it does not guarantee sales or collections.
2. Eligibility and accounts
The service is intended for businesses, not personal consumer use. You must be at least 18 and authorized to bind your organization. Provide accurate account and business information, keep it current, protect credentials, and notify us promptly of unauthorized access. Your organization is responsible for authorized users and account activity.
3. Trial, plans and limits
New organizations receive a 3-day free trial with no card required. No payment is collected automatically when the trial ends. Without a paid subscription or separately granted access, the workspace becomes read-only. Starter, Business and Pro are available monthly or annually. Prices, currency, taxes, billing frequency and lead/AI-message limits are shown before purchase. Trial workspaces use Starter limits; paid limits reset for each applicable usage month. At the limit, new manual leads or AI replies may be blocked; incoming messages and webhook leads may still be recorded. Do not circumvent limits.
4. Paddle, billing and renewal
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Paddle processes payments, invoices, applicable VAT/sales taxes and refunds. Paddle’s Buyer Terms apply to order and payment mechanics (https://www.paddle.com/legal/checkout-buyer-terms). Subscriptions automatically renew monthly or annually at the disclosed price unless canceled. Annual fees are billed upfront. Approved upgrades take effect immediately with proration; downgrades take effect at renewal. Changes to billing interval are shown for confirmation before they apply.
5. Cancellation and refunds
An organization owner or admin can cancel through Billing or Paddle’s customer portal. Cancellation stops future renewals, with access continuing through the paid period; a scheduled cancellation can be withdrawn before it takes effect. The first payment of a new monthly or annual subscription has a 14-day, no-questions-asked money-back guarantee. Renewal payments are non-refundable except where law requires otherwise. See our Refund Policy and Paddle’s applicable terms. Failed payments may lead to restricted access after the applicable grace period.
6. Messaging consent and acceptable use
You must establish a lawful basis and obtain required opt-in consent before messaging your customers. Comply with WhatsApp Business/Meta policies, the customer-service window, template rules and applicable anti-spam/privacy laws. Honor STOP and other opt-outs promptly; do not contact people who withdrew permission. Prohibited uses include unlawful activity, fraud, spam, harassment, hate speech, exploitative or deceptive deepfakes, infringement, malware, security probing, unauthorized scraping, reverse engineering, resale without permission, and bypassing safeguards or AI restrictions. You must have rights to all submitted content and prompts.
7. AI supervision and outputs
AI replies can be inaccurate, incomplete or inappropriate. You are responsible for prompts, configuration, customer consent, verifying outputs and supervising conversations, including human handoff. The AI identifies itself as an AI assistant; do not configure it to impersonate a human. Outputs are not regulated legal, medical, financial or other professional advice. No output is guaranteed unique, accurate or free of third-party rights. We may filter/refuse outputs, restrict or remove unlawful content and suspend repeat infringers. Rights-holders can report suspected infringement to support@callbackcash.com with the affected content and evidence of rights.
8. Data and intellectual property
Your business retains ownership of its leads, messages, conversations, prompts and other submitted data. To the extent permitted by law and applicable third-party terms, you may use generated outputs; no exclusive ownership is promised. You grant us a limited right to host and process your data only to deliver, secure and support the service and meet legal obligations. For your end-customer data we act as processor on your instructions; you remain controller. We retain all rights in our software, documentation and branding and grant a limited, non-exclusive, non-transferable right to use the service during authorized access. 9. Third-party services
Delivery depends on Meta WhatsApp, OpenAI, Paddle, hosting/database and email providers. Their terms, availability and policies also apply. You are responsible for your third-party accounts and permissions. We do not control their outages, policy decisions, deliverability or AI responses. Changes may require adjustments to integrations.
10. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security/fraud risk or serious/repeated policy violations, with notice where practicable. You may stop using the service and cancel renewal. Ending access does not cancel outstanding payment obligations or statutory rights. Contact support promptly to request export or deletion of customer data; retention and backup handling follow the Privacy Policy, and continued access after termination is not guaranteed.
11. Warranties and liability
To the fullest extent law permits, the service is provided as is and as available, without implied warranties of merchantability, fitness or non-infringement. We do not guarantee uninterrupted or error-free service, recovered revenue or delivery of messages. Neither party is liable for indirect, special or consequential losses, including lost profits, goodwill or data. Our aggregate liability under these Terms is limited to fees paid for the service in the 12 months before the event giving rise to the claim. Nothing excludes liability that cannot legally be excluded, including fraud or death/personal injury caused by negligence where applicable.
12. Indemnity and general provisions
To the extent law permits, your business will indemnify us against third-party claims and reasonable costs arising from unlawful use, infringement by your inputs/content or material breach, subject to prompt notice and reasonable cooperation. Neither party is responsible for events beyond reasonable control. You may not assign this agreement without consent; we may assign it in a merger or transfer of the business. If a provision is unenforceable, the remainder continues to apply.
13. Changes, governing law and contact
We may update these Terms; material changes will be notified reasonably in advance through the service or account email. Continued use after the effective date constitutes acceptance, subject to mandatory law. Israeli law governs, and courts in Haifa, Israel have exclusive jurisdiction, without limiting mandatory rights.
